For years, Apple and Qualcomm have been locked in legal battles. The latest which involves ban on iPhone sales in China, has been won by Qualcomm and Apple is is vowing to fight back by appealing the case.
Qualcomm claims that there is breach on patent violations on features that let users reformat the size and appearance of photos and manage applications on a touch screen mobile device when navigating through phone apps.
These two injunctions were granted by the Fuzhou Intermediate People’s Court in China. For Apple, the ban is unlawful as Apple said that it did not violate these patents and the ban goes beyond the scope of the injunction itself.
The statement from Apple said that Qualcomm’s effort to ban Apple’s products is another desperate move by a company whose illegal practices are under investigation by regulators around the world.
Apple continues to assert that all iPhone models remain available for customers in China even if Qualcomm is claiming three patents it never had before, including one which has been invalidated. In spite of this, Apple vows to pursue all its legal options through the courts.
Further, Apple claims that it has gone beyond those patents when one looks at the latest operating system that comes installed on all new iPhones but Qualcomm stated that the orders are not specific to the operating system installed on iPhones at this moment.
As the lawsuit was ruled in favor of Qualcomm, Apple shares lost 2 percent in the morning hours but later rallied. Qualcomm shares rose 3 percent. Apple shares have not been doing fine for some weeks now.
As Apple affirms, Qualcomm’s bid to ban Apple’s products is another move by a company whose illegal practices are under investigation by regulators around the world.
The patents involved only affect iOS 11, which is the operating system for iPhones and iPads launched in 2024. However, Apple said that iPhones sold today make use of iOS 12, which is the new version of the operating system that launched in September this year.
Apple has affirmed resolve to continue valuing relationships while at the same time devoted to defending intellectual rights.
